In this document "attribution" and "attribute" refer to the same item.
We, us, our, website, WSS, and software refer to WebStoreSoftware.com and the WSS web store software product. You, and your, their, customer, consumer, buyer, purchaser, refer to the customer who purchased the software for use on their domain.
The WebStoreSoftware attribution "powered by WebStoreSoftware" (including the WSS attribution image icon) must remain on the bottom of your WSS software install as per the license agreement. This document lays out specifics in which the license agreement has not.
The WebStoreSoftware attribute styling may only be changed to effect the text color and/or icon color and such colors must allow the WebStoreSoftware attribute to be visible on the page without any special modifications. We have several icon colors available which can be found inside the images folder of the software in the images/attributes folder. So if a different color icon looks better on your domain then you are welcome to change the icon by selecting one of the other available WebStoreSoftware icons using the admin section of the software. Under no circumstances is the WebStoreSoftware attribution to be changed in any way other than described here in this document.
Any variation or modification to the css or attribution which changes the attribute's appearance or styling in any way other than what is described in this document is a violation of the license agreement.
Violations: Violating the attribution agreement is a serious matter. Depending on the circumstance, you could be refused technical support, refuse to provide you updates to the software, have the software locked, have a warning placed on the software page which displays that the violation has occured, or even be denied any further service from WebStoreSoftware.com and forfeit any refund if monies have been paid, or any and all of the above at our discretion.

By listing or using any goods in the WebStoreSoftware Store you agree to be bound by the WebStoreSoftware Store Terms of Use. This document governs policies regarding content and structure pertaining to the WebStoreSoftware Online Store. These policies will be strictly enforced. This enforcement will allow for better products, and security of the products available in the store as well as for the developer who sells them. Communities with rules earn respect, those without earn havoc.
Merchant Background Checks: Background checks are done on a case by case basis and are not always required. Consumers should always continue to do their research and decide for themselves if a product or service or merchant is trustworthy. We are not responsible for that determination, it is always consumer beware.
WebStoreSoftware reservers the right to refuse service at any time with or without notification.
Definitions:
The Terms - The WebStoreSoftware Store Terms of Use.Intended Use: The Goods are intended to be used with the WebStoreSoftware version closed source software.
Goods Licensing: Free Goods in The Store can be licensed under any license that may complement but not override any parts of these Terms. Commercial Goods in The Store must be licensed under the WSS store license just like any other product or service, which may complement and/or override any parts of these Terms.
Acceptable Goods: Any Goods submitted to The Store must comply with our acceptable per our established policies. These may include but not limited to the following
The Goods that are illegal in the USA or in the country of The Vendor’s residence. Also Goods of objectionable nature including but not limited to: Nazism, Race discrimination, Hate-speach, and propaganda.The Goods that directly damage the normal workflow and/or endangers data safety and confidentiality of The User’s website. It is also recommended to avoid any known program code weaknesses that can result in compromising the program code by malicious 3rd parties.The Goods with false advertising in The Store. The Goods of substandard implementation quality that may hurt user experience. The Goods that do not contribute substantial value to The User’s website. The Goods that duplicate items in the store without offering additional substantial value. The Goods which listing violates copyrights, commercial agreements, and other obligations to third parties. The Goods which violate any WebStoreSoftware policy, national or international laws.
The Store reserves the right to deactivate listings of Goods that the editorial staff deems non-acceptable without prior notice but you can expect reasonable explanation upon request.
Parties Responsibilities: WebStoreSoftware can not be held responsible for any direct or indirect damage caused by using any Goods listed in The Store. WebStoreSoftware reserves the right and takes the responsibility to deactivate any and all Goods no longer supported and/or updated by The Vendor, and/or those receiving excessive negative feedback.
Product Display Variables Descriptions and Icons: WebStoreSoftware is held harmless for any direct or indirect damage caused by a misrepresentation of a product value by a vendor or via icons listed on our website or in our software. It is the vendor's responsibility to truthfully and wholey describe their product and use product icons in a truthful and responsible way. WebStoreSoftware reserves the right to remove any product in which customer feedback and complaints lead us to believe that the product is misrepresented in any way.
Vendor: The Vendor can not be held responsible for any direct or indirect damage caused by using their Goods listed in The Store if The Goods comply with all WebStoreSoftware established policies and of these Terms. The Vendor takes full responsibility for supplying up-to-date Terms of Use (including Refund Policy) for their Goods listed in The Store as paid. The Vendor undertakes to maintain the working state and provide appropriate support for their Goods listed in The Store. The Vendor undertakes to grant a license for any paid Good acquired by The User from The Store within 72 hours after the completion of the purchase, unless an appropriate different condition is stated in the specific Good's Terms of Use.> While terminating The Good's listing in The Store, The Vendor undertakes to notify all Good's Users about the decision beforehand (at least 7 working days), and take all steps possible to limit any negative consequences of this decision. The Vendor agrees not to artificially inflate or manipulate The Store ratings and reviews. The Vendor holds the right to cancel licenses granted to The User in case of arising unsolvable conflicts/disputes, with full or partial refund paid to The User in accordance with specific Good's Refund Policy. By default, The Vendor grants The User item licenses on terms of guaranteed lifetime updates, on free products only. Unless otherwise is explicitly stated in the Terms of Use of a specific item. The Vendor must allow 1 year (12 months after purchase date) for each sale. After such time a Vendor can charge for updates at their discretion.
User: The User undertakes to thoroughly read the Good's license and Terms of Use before the purchase/download, and refer to said documents in subsequent usage. Not knowing is not a valid excuse if the information is posted on the store or as part verdors product information. While providing feedback for any Goods, The User undertakes to be as objective and truthful as possible. The User undertakes to fully cooperate with The Vendor while resolving any issues or reports regarding The Goods submitted by The User. The User has the right to provide feedback and/or reviews about The product either publicly on The Good's page in The Store, or privately - directly to The Vendor. The User has the right to demand support service for The Goods at the extent stated by The Vendor in the appropriate Good's Terms of Use.
WebStoreSoftware: WebStoreSoftware reserves the right to not list any Goods deemed non-acceptable under our established policies, or any Goods breaching any store policy. WebStoreSoftware reserves the right to update and change the Terms of Use at our sole discretion at any time with or without prior notice. However WebStoreSoftware will publically announce any major material changes to the Terms on our forum or other established public media. Continued use of the Store after publication of such modifications, with or without notification, constitutes binding acceptance of these modified Terms of Use.
Description: Each item in the store must have a proper typed description of the product in question on the product page. It must be in English and must be clear as to the products purpose and function. You MAY NOT substitute the description for a link to any web page. However, if you would like to put a company link in the product description you may do so after/following the proper description.
Links: You are only allowed 1 external link on your product page and it must be located in your product description. That link must link to a valid professional website owned by you (the seller of the product) and it must not be forwarded in any way. That link may NOT link to any pornographic material or adult website whatsoever. It also must not link to any affiliate content and must not contain any affiliate identification as part of the link. The link must not link to any news websites or any other form of website whatsoever other than your personal website in which the entire content of such website is regarding computer programming, coding, or other venture owned by you in which you provide similar products such as plugins, mods, or aps. All other content and links are forbidden and are a violation of the store license.
Product Images: You are required to have and maintain a minimum of 3 images showing your plugin functionality. These images cannot be of the same process and they all must be different in that nature. The images must be of your plugin process and not an image of a site logo, avatar, or any other non related image. These images must consist of screenshots showing your plugins functionality.
Product FAQ Feature: The product FAQ (Frequently Asked Questions) Section is allowed just for that purpose and no other purpose. In this section you can post frequent questions that you have received from customers and you can supply answers to those questions. The purpose of this section is to allow the consumer the chance that they might find their question on the list along with with the answer they need. There will be a limited maximum set space for this section. This space does allow some html tags such as ul and li tags for listing purposes. Abusing this space either by posting any other html tags or other languages in this space or using this space in any other manner will be grounds for product removal and/or vender fines.
Support Log: You are required to use our support log attached to your product to log the entire support process for your plugins. This shall include all support inquiries and all support replies from yourself and your product customers. Private support techniques which are outside of the wall of WebStoreSoftware are not allowed. The use of any kind of external support process by any means other than the provided support log is forbidden. The support logs must remain viewable by the public to allow the public to decide for themselves the kind of support you offer for your products.
Proper Conduct: This item will be covered in more detail in the WebStoreSoftware Store Developer Terms section which is available to you on our policies page.
One Account Only: You shall have only one business account in the WebStoreSoftware store. This account shall include all the products you wish to sell in the store. If your account is ever suspened or flagged you MAY NOT open another store. As a business professional we require you to act in a professional manner in which would prevent your store from being flagged. More about proper conduct will be covered in the Developer Terms section of the policies page. You may close your store at any time you wish by simply making a request via our customer service department that you wish to close your store. Once your store is closed WebStoreSoftware will provide an internal process for which your current customers will not be subject to a "no plugin" experience.
This means that current customers will still be able to use your plugin but will understand there is no more support for that plugin, and no more sales will be generated by anyone for that plugin including WebStoreSoftware. The customers will also be stictly warned not to violate the developers rights of ownership and in no way shape or form are they to sell, distribute, rename, or otherwise use your plugin other than its original purpose. The rights to ownership of all plugins will remain with the developer forever!
As best we can in our ability to do so, we will track if your products end up in another store. If this happens that other store will be immediately closed. The purpose of "one account only" is to give the consumers a fair view of how you conduct business and with that they deserve to see how you have acted and how you have supported your products over time. Consumers tend to be very forgiving as long as you are honest with them, even if you make a mistake and get flaged you can survive it by being passionate about taking care of your customers. If you leave the WebStoreSoftware store on good terms we will gladly accept you back however we will attempt to re-activate your old store first before any other option is applied.
Changing Store Name: Once you have chosen a name for your store and saved your name within the WSS software, you may only change your store name 1 time within the WSS software. That name change must occure within the first 30 days of your stores creation date within the WSS software. No store name changes will be permitted after the 30 day limit. This is to help prevent bad store links, time consuming record maintenance, customers confusion, merchants that abuse the feature, and other issues that could arrise from such changes. If it is imperative that you change your store name for legal issues then please contact us using our support contact.
Price Cap: There will be a price cap on all plugins of $60. If you feel that your plugin is rare enough, good enough, used alot of resources, or will require high maintenance, and you feel you need to demand more for your plugin, you may contact us and give us the reason why you feel your plugin is worth a higher price. You may also include your request for a higher price when you apply for plugin approval. At that time our professional programmers and market research staff will do their investigation as to the substance of your request. Their word is final and there is no appeal process. We simply do not have the staff or the time to keep visiting the same request over and over again. There are 3 ways that such an investigation can terminate should you include this in your plugin approval process.
At our discretion we may from time to time increase or decrease the plugin cap price in order to keep sales flowing and traffic in the store. This may be true in economic hard times as one example
Plugin Approval Time: The standard plugin approval time is 8 days from the time we recieve the request. All requests from anyone inquiring about the approval of any plugin that is within that timeframe will be ignored and not replied to. If and when we have the time to get the approval done faster, we will. But otherwise you must wait 8 days from the date we receive the request. If your plugin is not approved then you will need to repeat the waiting period again. In some cases if the needed changes are small enough and we can approve it faster, we will. However, please do not request followup until the waiting period has expired.
Arbitration and Disputes: If there is a problem with a store product and the product is not as described (please read the product description and any readme file that exists for the product first), or you feel that the developer refuses to support their product properly, or if a developer feels that another product is too similar to their own product and they wish to challenge the legality of a product, then a request for arbitration and dispute can be submitted. Please send your request titled "Request for arbitration and dispute" using the customer service email available on the bottom of the WebStoreSoftware website. We will then investigate and gather information from all parties involved (if still available within reason) and our decision is final. Keep in mind that it is your responsibility to provide the facts in the case. Facts mean documents, chat log, screen shots, support log, images, and other items that can substantiate the case or no case.
Fines: Developers/merchants could be fined for violations of store policy. The fine amounts are listed below. If you are fined and it is our decision that the fine is the only remedy required. Your store can remain open while you pay off your fine. However, your fine must be paid or partially paid from each sale that occures from your store until that fine is payed in full. Percentages can range from 20% to 90% of each store sale based on a mutual email agreement between the vendor and WebStoreSoftware. If you receive any other fines during the time that your current fine is being payed your store and your vendor membership will be terminated and you will not be allowed to to reapply for membership for the term of 2 years from the date of your membership termination.
Fine Amounts: The level of fine violation is at our descretion.

Remember that severe violations may also include down time or termination of your store and membership. Our sincere wish is that we never have to fine anyone and we hope that we never have to. However, fines can also be a way of maintaining a proper professional store environment for both vendor and consumer.
All store fines are due net 10 days - which means that they are due in full by the end of the 10th day of the month. Allowing for a small grace period, stores that have not paid their store fines by 8am on the 11th day of the month will have their store deactivated until fines are paid in full, at our discression. The store merchant will be notified by email if any such action is taken. Repeated asessment and/or late pays of store fines is grounds for termination of your store.
Paying Store Fines: Store fines can be paid ONLY by visiting our Purchase Page and choosing the payment option that reads "Merchant Store Fines". We do not accept any other forms of payment at this time. It may take up to 24 hours to process your payment on our system.
Violations: We take these terms seriously and so should you. As a professional we would think you would agree. Violation of the store policy can include but not limited to a warning, your plugin being denied approval, your store being locked, a fine, a public penalty text placed on your store which may expire or not expire, or any and all of the above at our discretion. Remember that being a part of our online store is a privilage not a right, please act and conduct yourself accordingly.
Store Fees: Running a store takes resources regardless if it is a brick and mortar business or online business. Those resources cost money in manpower, along with physical and electronic presence. To provide those services we must charge store fees. Store fees at WSS are flat rate fees with an additional POS (Percent Of Sales) fee also asessed for high volumn monthly gross sales. So each store shall be asessed a monthly store fee as follows:

The terms vendor, merchant, and store owner all relate to the person who is in charge of the store in question.
This page will govern our store vendor terms of service and expected conduct.
The terms vendor, store owner, developer, and merchant are interchangable and mean the same, someone who has an online store that offers products or services for sale. The terms your, you, also refer to the vendor or merchant of the store. The terms us, we, our, WSS refer to WebStoreSoftware. The term customer, their, them, and consumer refer to the purchaser of a product or service from a vendor.
Overall: Being a vendor for WebStoreSoftware should be no different than any other task that you undertake. WebStoreSoftware expects you to take pride in your work, every day, every customer you talk to and and every product you offer. Good character shows but so does bad character. Your character and your ability to take care of your customers needs will make you or break you when it comes to being a successful merchant. And this is for any job, career, or project inside or outside of the work environment, simply put "character matters"!
Initial Merchant Application Fee: Each vendor without exception (unless otherwise stated) must pay a one time merchant application fee of $25 USD. There are several reasons why we ask for this fee. First our experience has taught us that overall, merchants who pay an application fee tend to take their merchant responsibility more seriously and do a better job at behaving themselves. Also the one time fee helps to pay for any background checks, investigations or any other cost associated with processing that application. The costs associated with each applicant is on a case by case basis. And finally the fee is put right back into the business to help us offer you better ways to do what you do. If a merchant leaves the store for whatever reason and then returns at a later date and time, that merchant is required to pay another one time application fee.
Merchant Application Fee Refund: If your merchant application is not approved for whatever reason, you will receive a full refund of the application fee minus any costs incurred by us during the application process. Under normal conditions this is not an issue and full $25 refunds happen quite often.

Vendor Self Image: Each vendor without exception must provided a self image (picture). This image must be of proper size and condition to see the vendors face with great clarity. The vendor face in the image must not be obfuscated in any way other than normal conditions (ie.. beard, mustache ect..). The image must also be of and show the actual vendor which has applied for the said vendor account, no substitute images are authorized. If a vendor has a valid reason they do not want their image to be shown to the public they can contact us at our support email and we will take that requrest under consideration. Images must not include violence and must respect race, religion, gender, culture, or any other moral professional quality. Fake images or images which violate this policy will be removed and the vendor shall have 3 days to submit another image, after which the vendor account (including store) will be put in suspension status.
Vendor/Store Suspension Status: If a vendor and/or store becomes suspended it is a very serious matter. We do not take such a thing lightly. Suspension status means that the vendor and store are restricted from conducting business until the matter causing the suspension is corrected or the expiration time expires. So in this case considering it is a critical violation which causes this action, if a vendor/store is in suspension status and remains in suspension status for 30 days, the (next day or 31st day) the vendor/store may be terminated with or without notice. The only exceptions to his policy is if the vendor/store has violation fines they are making payments on, and/or if we feel we need to keep the store on file for legal prosecution.

The vendor must make satisfactory efforts to insure that the usage of icons including but not limited to the coupon, onsale, featured, ratings, and favorited icons or data related to them is not faked, rigged, modified or in any way misrepresenting the true value and quality of the product and/or their customer product ratings/feedback. The bottom line is if you lie, rig, or bend the truth about your product in any way, your product can be removed without notice and you may receive a store fine in the process. So be honest and show some integrity. We all want sales, but get them the right way with customer loyalty, quality products, and honesty. We base satisfactory efforts based on what a general merchant's actions would be in such an environment.
Conduct: You will be expected to conduct yourself as a professional at all times. Being a professional does not mean that you must be a "yes man" or that are you are required to sacrifice your principles and values as part of being a vendor for WebStoreSoftware.com. Actually you never have to do those things to be successful at anything. Remember the customer is NOT always right, but the customer IS ALWAYS the customer. What that means is that this customer purchased your product and has the right as a consumer to fair and honest treatment. Even you as a consumer should agree with that as when you purchase things you deserve the same rights. So do not treat your customer with any less dignity. As long as you provide your customer the opportunity to allow you to fix an issue and you do so in a respectful way and in a timely mannor, then few could ask for anything more.
Customer Complaints: If your customer files a complaint against you, you need to consider this a positive matter. The fact is that there is no better time to prove just how customer service oriented you are. For example: if someone told you that a car can fly by pushing a button, how are you going to know unless you push the button to test it yourself. So think of complaints as little tests that if you succeed you will win that customers loyalty for a very long time. Plus that customer will tell others how well you did and that means more business for you. So think about complaints as a way to earn a positive advertisement for your products or services. But remember it works both ways, if you treat your customer with disrespect and talk down to them instead of too them, well you know, we dont need to tell you what happens then do we.
The settlement of complaints with WSS does NOT in any way interfier or override those of credit card companies, banks, Paypal® or any financial institution. They have their own process and that is entirely a seperate entity, WSS has NO involvment in those proceedings. The purpose of having a dispute or complaint process at the local level with WSS is to try to solve the issue before it goes to a higher level. Also if documented the local complaint process could provide documentation in support of a case if it does go to a higher level.
There is a very old principle in doing business that we learned early on in our careers and it still works today. The principle consists of "under promising and over delivering". Dont promise your customer the world or the stars because then there is no way to improve and you end up boxing yourself in a corner. Promise them something less and then deliver alittle bit more than you promised and you have succeeded in providing that customer a fair transaction and postitive experience. Most customers are pretty fair and some are very respectful of what we do. But yes there are some customers that even the best customer service representative in the world could not satisfy. And for those customers you just do your best and let the chips fall where they may, and then move on.
So if a customer files a complaint against you, the process is as follows:
WebStoreSoftware team members with products in store: For those team members which also decide to place items in the store for sale. That team member will be held at a much higher standard because of being a team member. The product quality needs to reflect professionalism and that team member needs to privide excellent customer service. Above and beyond that of the normal vendor. The team members action or inaction can greatly effect our success. So just remember, always be on the best behavior and always put out quality products and excellent support.
Language: You must never use any kind of profanity toward a customer. You must never insult a customer with intent or malice. If you and the customer cannot work out a solution then you should take the initiative to request arbitration.
Arbitration means that someone from WSS or other impartial party acts as a mediator between the two parties in the hope of keeping the discussion focused and on track. And hopefully bringing resolution to the issue.
License Keys: If WSS provides a license key process, you must never revoke an license key without first filing a request for arbitration and allow WebStoreSoftware to assist you in taking other steps to solve the issue. Revoking a license key is a very serious matter and is not taken lightly. It must be held off until the very last step to avoid possible legal issues.
Privacy: In any case WebStoreSoftware shall never ask for or release any identifiable information from either party as to their identity other than the facts of the case including support logs and such and or the required information regarding the parties involved to discuss and perform our duties. Your support chat logs and your verifyable store ownership are all we need. We may ask you to send us an email from your paypal email to verify your account ownership.
It is highly advisable that you also read the store terms of use available on our policies page. It also has information regarding expectations, conduct and in store policies that specifically effect a vendor.
Arbitration and Disputes: Please see the same titled section in the store terms of use available on the policies page for more information on this process.
Violations: We take these terms seriously and so should you. As a professional we would think you would agree. Violation of the vendor terms can include but not limited to a warning, your termination from the vendor program, a fine, a permanent or temporty notice placed on your public vendor profile, or any and all of the above at our discretion.

Not every condition will be covered but we hope to put enough general content and accepted practices, and tolerance here to let you know what is expected of your coding. We ask this of you because it matters. It matters in security of our server and in our overall reputation to offer quality products from professionals.
Coding/Product Quality: Product quality is incredibly important to the success of everyone's involved. In that spirit WebStoreSoftware will be enforcing a coding/product quality requirement. This requirement will not have exclusions or exceptions of any kind. This requirement will be discussed in more detail on its own special page and also inside the developers store terms as it applies to either. However to paint you a basic picture of what the requirements "might" look like, here are some basic requirements below.

Internal file documentation is required. We are not asking you to document every detail of your program. What we are requiring is simple basic respect from one professional to another. And that means documenting difficult, unusual, rare, or involved code with basic internal comments so that it saves our testers and programmers approval time. Make internal notes as to what the code does or its function and end result. Two basic php examples follow.
This is very simple to do and it takes no time at all. It could even help you to better code your project. You can decide if you want to document each page as a whole or document individual code within the page. Remember we have professionals looking at your code, many things we can figure out however please try to help make the approval process faster by documenting more involved code in your project. We ask you do the same for your html files as well.
We all have code in our projects that we may want to save for another day or when a process/function may be available in the future. This is understood and accepted. However, if your projects pages have code after code after code commented out then it will not be approved.
We have had developers that have had 600 lines of code on a page and 90 percent of that page was commented out. Another developer had commented out code about ever 20 lines, there were 20 lines of code commented out back and forth all down the page. It was as if they were copying the code from somewhere else and if it did not work they just commented it out and tried something new. This will not pass and your product will not be approved.
We suggest that you remove such comments and save them in your own developement area for when that day comes that you need them. Do not use program files to store and maintain unneeded and unused code. We are not talking about 5 or 10 lines that need to stay in place, such things are not an issue when it comes to approval. What we are asking is that do not be abusive or take our flexiblity for granted. If you get sloppy and leave huge code sections commented out in your release, your plugin will not be approved. Keep it clean and keep it professional. Just because very few people will see the code does not give you an excuse to be unprofessional, take pride in your work and your coding habbits.
All database queries must be at a minimum in the protected files in which are designed for that purpose.
For example for Oxwall plugins, all queries should at a minimum be in the bol/service.php file. We would prefer that you follow professional methods and use the service file for its intent. This means that your plugin php function calls the function in the service file, that function calls the function in the dao file specific to that table, and then the result is returned back following the same path in reverse to the original request in the plugin php file. DO NOT place any database queries outside of the bol folder, your plugin will not be approved.
For other software if there is a secure class in which is designed to place your queries then do so, dont be lazy, it only takes a few minutes to create a fuction or method or class and protect those queries.
If it is determined that your program uses anyones elses code in which the required attribution has been removed, your program will not be approved. There are lots of free snippets and other items out there that are free to use as part of your programming project. Many of them require that you leave the original programmers attribution on the page in exchange for using it on your project. Its simple, leave the attribution there! I am sure they worked hard coding that, so give them the credit they ask for and move on.
